Athletes Waiver

1. ASSUMPTION OF RISKS:

By registering my athlete (“the Athlete”) to participate in DimeHoops Basketball programs, I, as the parent or legal guardian, acknowledge and understand that the sport of basketball involves inherent risks, including but not limited to the risk of physical injury and property damage. I understand that:

– The game of basketball is played on courts and other surfaces whose conditions are variable and unpredictable.

– Participation involves interaction with other players who may behave unpredictably.

– The environment, including weather and man-made obstacles or equipment, can change without notice, increasing the risk of injury or property damage.

– Such risks, dangers, and hazards may be caused or contributed to by the negligence of DimeHoops Basketball, its staff, other participants, or third parties, including the failure to take reasonable steps to ensure the Athlete’s safety.

I am aware that injuries are common in sports, and I freely accept and assume all risks, dangers, and hazards associated with the Athlete’s participation in or attendance at DimeHoops Basketball events and activities. I fully assume all risks of possible personal injury, death, property damage, or loss on behalf of the Athlete. I understand that basketball requires significant physical exertion and acknowledge that it is my responsibility to consult a physician before allowing the Athlete to participate in this or any other strenuous physical activity.

2. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT:

In consideration of DimeHoops Basketball accepting the Athlete as a participant or attendee, I, for myself, the Athlete, my heirs, executors, administrators, successors, and assigns, hereby agree to the following:

– I release, waive, and forever discharge DimeHoops Basketball, its owners, sponsors, and all respective agents, employees, volunteers, officials, contractors, representatives, directors, participants, and attendees (collectively referred to as the “Releasees”) from any and all claims, demands, damages, costs, expenses, actions, and causes of action, whether in law or in equity, arising from death, injury, loss, or damage to the Athlete’s person or property, however caused, as a result of the Athlete’s participation in or attendance at DimeHoops Basketball events.

This includes claims arising from negligence, breach of contract, or breach of statutory duty of care, including any duties owed under applicable laws.

– I agree to hold harmless and indemnify the Releasees from any and all liability incurred by them as a result of, or in any way connected with, the Athlete’s participation in or attendance at DimeHoops Basketball events.

– I grant DimeHoops Basketball the right to use photographs, audio recordings, and/or video footage in which the Athlete appears, in any materials related to DimeHoops Basketball, including but not limited to brochures, newsletters, websites, social media, or other media platforms.

3. ACKNOWLEDGMENT:

By completing the registration for my athlete, I acknowledge that I have read, understood, and agreed to the terms outlined in the above RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY AGREEMENT, and recognize that I am waiving certain legal rights on behalf of both myself and the Athlete.
